Task Hours (herein after referred to also as 'application' or 'solution' or 'this website' or 'service') is a cloud based time tracking and productivity monitoring application. It uses client applications for different platforms (Windows, Linux, Mac, iPhone, Android etc.) as well as web based user interface for recording, monitoring and analyzing time utilized on different tasks. It also involves certain features like Screen Capturing, Application Logging and Browser monitoring to report the activities that are performed during the logging of task hours.
Task Hours solution (developed by Yukti Solutions Private Limited herein after referred to also as 'owner' or 'development company' or 'we') is provided to you as a cloud based service (along with its client applications) solely for monitoring the tasks/activities of your team or employees or contractors (whether local or remote) and is subject to the Terms of Service / Use as given below. You agree to use the application for its designated use. We reserve the right to amend the terms of use & conditions at any point of time with or without any prior notification. You must agree to all terms and conditions mentioned within this term of service and privacy policy agreement.
Before you accept this agreement, you must be atleast 18 years or above the legal age as per your country or location when you are lawfully eligible to undertake such agreement. You represent and warrant us that you have full power, authority, and legal capacity to enter into the Agreements and abide by its obligations, and if registering on behalf of a company or other entity, that you have been conferred full authority to bind your principal or employer company. Also that you have provided complete and accurate information to us. Also you will pay us all charges at the prevailing rate when these charges were incurred.
In order to use Task Hours a membership registration is required. You agree to provide complete, true and accurate information, as may be required, when registering on this website and to promptly update these should there be any subsequent changes in the information provided. We reserve the right to suspend or terminate your membership and/or access to the application if at any time we find that the information you provided are false, inaccurate, or incomplete.
The access to the application is secured with login information (such as user name and password, also referred to as credentials) and you agree to keep this information secure and confidential. You will also be responsible for all your activities and transactions, including payment of purchases and fees incurred, arising from the use of your login name and password.
In case of unauthorized use of your membership you must immediately notify Task Hours team of such usage and also request to stop the service or change the login credential in writing via email. We shall assume no liability whatsoever for any unauthorized access to the application using your credentials prior to such notice.
Although registration on Task Hours is free, its' services are subject to certain montlhy subscriptions and fees as mentioned on the pricing section of this website. These subscription fees shall be payable through credit card. By using a credit card for the payment of the fees, you represent and warrant us that you are the authorized card holder and absolve us of any liability for any charges arising from its use.
We shall charge the fees to your credit card single time or on a monthly basis depending upon your subscription. We reserve the right to amend our schedule of fees and/or change our billing methods. If you find any amendment unacceptable, you may cancel your membership at any point of time. You agree that the fee charged before cancellation of the membership or subscription is not refundable completely or any part of it. You also agree to pay any sales or use taxes which the application may be subjected to.
A membership can be cancelled at anytime by the subscriber without specifying a reason. However, the fee paid for the subscription cannot be refunded in case of monthly subscriptions. In case of quarterly or annual subscriptions, fee may be refunded for the remaining months after deducting the applied GST / Taxes on the invoice.
You agree to use this application in accordance to its intended use and not for any activity that is illegal and may harm other people financially, physicallly or psychologically. You must not use this application in areas where use of such service or application is prohibited by their local or international laws. You agree that you will not be involved in any activity that may harm the reputation of this solution in any manner.
You understand that the subscription fees you pay are only for the "usage" of the application. It does not transfer you any ownership or intellectual property rights of this application. We reserve all such ownership and intellectual property rights of this solution.
You agree to indemnify and hold us (Yukti Solutions Private Limited), and its subsidiaries, affiliates, officers, agents, and employees, free and harmless from any claim or demand, including those for reasonable attorneys' fees and/or litigation costs, made by any third party due to or arising from your use of the application and for any violation of the terms of use or rights of any third party.
We shall not be liable for any (direct, indirect,consequential or special) damanges due to the use of this service. However, for any circumstances that may impose financial claims on the owners (Yukti Solutions Private Limited), they cannot exceed an amount of $ 1000.
Arbitration for any controversy or claim shall proceed independently and shall not be consolidated with any other arbitration proceedings relating to claims or controversies involving any other parties. The arbitration proceedings shall be exclusively conducted within New Delhi (India), and judgment on the arbitration award may be entered with any court having jurisdiction. Either party herein may seek appropriate interim or preliminary relief from a court of competent jurisdiction in New Delhi (India) to protect his/its respective rights or property pending the completion of arbitration. Should either party herein file an action in contravention of this provision, the other party may recover attorney's fees and costs not to exceed the amount of $ 500.
